Welcome to JWJ Travels!

We are excited to offer you our travel products and services. Before you book with us, we kindly ask you to carefully read and understand the following terms and conditions. These Booking Terms & Conditions, together with our Privacy policy and any other written information we brought to your attention before we confirmed your booking, form the basis of your contract with JWJ Travels. 

In these Booking Terms & Conditions references to “you” and “your” include the first named person on the booking and all persons on whose behalf a booking is made or any other person to whom a booking is added or transferred. By booking any of our products or experiencing a trip with JWJ Travels, you acknowledge and agree to be bound by these terms. 

If you make a booking for multiple clients, you are considered to have accepted these terms on behalf of all clients named in the booking. This includes minors and individuals with disabilities. All passengers travelling or participating in any of our Product(s) known as Getaways & Retreats indicate their acceptance of these terms. As the client who confirmed the booking, you will be our main contact person for all other clients on the booking. 

The terms of the whole agreement between you and JWJ Travels is binding and replace any previous agreements, whether written or oral.  These terms and conditions apply only to travels organized solely by JWJ Travels and not in conjunction with any other party or tour operator involved in a specific trip.

1. BOOKING AGREEMENT

No contract shall arise between you and JWJ Travels until we have received the deposit, and we have sent to you written confirmation. (This can be in the form of an email confirming our acceptance of your booking.)

By making a booking, the first named person on the booking agrees on behalf of all persons detailed on the booking that:

  1. he/she has read these Booking Terms & Conditions and has the authority to and does agree to be bound by them;
  2. he/she consents to our use of personal data in accordance with our Privacy Policy and is authorised on behalf of all persons named on the booking to disclose their personal details to us, including where applicable special categories of data (such as information on health conditions or disabilities and dietary requirements);
  3. he/she is over 18 years of age, and were placing an order for services with age restrictions declares that he/she and all members of the party are of the appropriate age to purchase those services; and
  4. he/she accepts financial responsibility for payment of the booking on behalf of all persons detailed on the booking.

At any time before a booking is confirmed, JWJ Travels reserves the right to increase or decrease prices of any Products and Services. JWJ Travels also reserves the right to decline any individual group and private travel booking at the Company’s own discretion.

PLEASE NOTE: We act in the following capacities, as Principal and Package Organiser in the sale of a ‘tailor-made package’, and as Agent in both ‘single service’ bookings (for example, an accommodation or flight only booking) and ‘ready-made package’ bookings (i.e. packages sold on behalf of third-party tour operators). Your confirmation and itinerary are subject to change without prior notice.

Upon receipt of your deposit, we will send you a confirmation email of your booking. If you do not receive a confirmation email within five (5) business days of making your booking, you must notify us in writing. After your booking is confirmed, we may send you additional correspondence regarding your trip with JWJ Travels, including a preliminary itinerary for your getaway.

Please note that the itinerary is subject to change at any time. JWJ Travels reserves the right to amend any part of the itinerary due to factors beyond our control, including but not limited to weather conditions, destination travel restrictions, local circumstances, third-party suppliers’ availability, or other unforeseen events.

2. PAYMENTS

Deposits are payable at the time of booking and the balance of payments are split into the following phases:

iii) The final balance is to be paid no less than the specified final payment due date upon which your event is due to start. Failure to pay by this date will result in a $20 per person late payment charge or could result in your booking being cancelled.

ii) Monthly instalments will be required, which will be broken down at time of booking. Late payments will result in a late fee of $20 per person/ per month or could result in your booking being cancelled.    
i) An agreed non-refundable deposit is payable at the time of booking. Full, monthly, or bi-weekly payments are used by us to enter into the contractual arrangements on your behalf and are non-refundable.

Payments can be made with a valid Credit Card or Debit Card via online payment system or online bank transfers made payable to “JWJ Travels Limited”.

2.1 Late Payment

If you fail to make payment within 7 days of the agreed-upon due date, you will have breached your contract. This could lead to the cancellation of your booked experience. If you encounter any challenges in making a payment, please send an email to notify us at Support@JWJTravels.com. You will be subject to a $20 late fee. We deeply value all our customers and will make every effort to assist you if you encounter any difficulties that may impede your ability to meet your scheduled payments. However, JWJ Travels reserves the right to allocate your reserved spot to the next eligible client on the waiting list.

2.2 Client Initiated Termination

You have the option to cancel your reservation within the first 14 days after making the initial deposit, but please note that the initial deposit itself is non-refundable and cannot be transferred to another trip. Beyond this 14-day period, if you decide to cancel your booking, including any deposits and any additional payments made up to that point, they are also non-refundable. All cancellation requests must be submitted in writing by the primary individual listed on the booking.

The cancellation fees are structured as follows:

  • If you cancel your booking more than 60 days before the scheduled travel date, the cancellation fee will be at least 50% of the total booking cost or the total amount paid to us at that time- whichever is greater at the time of cancellation.
  • If you cancel your booking within 28 days of the travel date, the cancellation fee will amount to 100% of the total booking cost.

All cancellations by you must be in writing and emailed to Company at the contact email address specified on the Website (support@JWJTravels.com).

It is advised to purchase trip cancellation insurance as a precaution. Trip cancellation insurance/ comprehensive insurance is the sole method for obtaining a refund for expenses such as flights and other non-refundable costs in the event of trip cancellation, whether it’s initiated voluntarily by yourself or due to actions taken by JWJ Travels.

2.3 REFUNDS

You may choose to cancel your participation in a JWJ trip at any time; however please note to the following cancellation policy below:

At JWJ Travels, we are committed to delivering exceptional experiences to our guests. As such, the deposit is non-refundable, and all payments made toward the balance of your trip are non-refundable after five (5) days of the payment being made. This includes full payments, and monthly or weekly instalment payments and any late fees. The only exception to this policy is if JWJ Travels cancels the trip in its entirety for any reason. In such cases, we will notify all affected parties via email and provide refund instructions.

We totally understand that unforeseen circumstances may arise, and for this reason, we strongly advise buying Travel Insurance to protect your investment and moneys.

Please also note that JWJ Travels is not liable for any incidental expenses or consequential losses sustained as a result of your booking being cancelled. This includes but is not limited to:

  •       Visas, vaccinations, or COVID-19 tests
  •       Flights, train tickets, or other transportation fees
  •       Loss of earnings or any losses incurred as a result of cancellation.

2.4 WHY AM I NOT ELIGIBLE FOR A REFUND?

When we present you with a package, it’s essential for us to secure your attendance at the Retreat by making earnest payments. Our suppliers (for example- hotels, venues, transportation, hosts, tour guides, excursion providers) require guarantees in advance from us to secure services. JWJ Travels will not provide refunds, discounts or any other reimbursement for services that Client missed or did not use where JWJ Travels, hosts or our expert coordinators & vendors are not responsible. This involves situations where your involvement in the Getaway/ Retreat is terminated due to your violation of these Terms or your own negligence.

3. CHANGES OR CANCELLATIONS BY JWJ TRAVELS

JWJ Travels may cancel the Getaway or any part of it for the following reasons:

Safety: If JWJ Travel or its suppliers believe that the weather conditions or other safety concerns are unacceptable and cannot be reasonably overcome.

Behaviour: If JWJ Travels reasonably believes that you may cause harm or damage to its reputation and other guests, the reputation of its suppliers, or the property of its suppliers.

Supplier failure: If a supplier or suppliers are unable to host the Getaway for any reason.

JWJ Travel reserves the right to modify any and all aspects of the Getaway, including but not limited to:

  1. The type of activities specified in itinerary
  2. The hosts or guides 
  3. Scheduling of each activity available during the Getaway
  4. The accommodation 
  5. The overall nature of the trip
  6. The items and/or services included with the Getaway
  7. The itinerary details

These changes may be made at JWJ Travel’s discretion for reasons such as:

  • Harmful, dangerous, or adverse conditions that may pose a risk
  • Third party failures that disrupt or prevent any part of the Getaway from proceeding as planned (i.e. vehicle breakdown, driver ill-health, vendor cancellations)
  • Lack of minimum group participation
  • Any other reasons deemed an operational or commercial necessity

You will not be eligible for any refunds if JWJ Travels makes changes to the Getaway. The itinerary is intended to serve as a template/reference point to the tour and destination. Please note that any references to specific activities, locations, or aspects of the itinerary are not guaranteed. JWJ reserves the right to make adjustments to the itinerary based on factors such as adverse weather conditions (rendering destinations or activities unsuitable), local circumstances, safety concerns, past client feedback, transportation or any other relevant considerations.

4. TRAVEL DOCUMENTATION

JWJ Travels will not assume responsibility if you are denied entry into or exit from any country or location due to incomplete, invalid or missing documentation. It is your responsibility to acquire and keep a valid passport and all essential visas, vaccination certificates, and other documents for the countries and places you will visit during the Getaway. Should there be any loss or expense suffered or paid by JWJ Travels or any of its third-party suppliers due to the direct result of your failure to secure proper travel documentation, you will be responsible for the full amount paid. Kindly refer to each country’s government & tourism website in advance of the Getaway date to ensure you have the correct documentation prior to travel.

5. TRAVEL INSURANCE

Travel insurance is advised for all participants on JWJ Travels trips. It is your responsibility to purchase your own travel insurance at the point of booking. Your travel insurance must cover you for the duration of the trip, in the event you are unable to join the Getaway and for all activities within the itinerary. We highly advise the purchase of adventure travel insurance for the coverage of adventure sports and activities including winter sports, paragliding, water sports like scuba diving and snorkelling, mountain sports, bike sports e.g. ATV bike riding, skiing and other potentially hazardous activities.  JWJ Travels is not responsible for any injuries and losses that you incur due to your failure to purchase travel insurance.

6. ADAPTABILITY

When you book a getaway with JWJ Travels or choose to travel with us, you recognise that this type of travel demands flexibility and that you authorise JWJ Travels to make justifiable modifications to the Getaway/ Retreat and itinerary. You also acknowledge that the itinerary, route, programmes, timing of activities, amenities, and mode of transportation may be altered at any time without prior notification due to unforeseeable circumstances or events beyond JWJ Travels’ control. Circumstances such as (not limited to) illness, issues in the destination location, flight delays & cancellations, mechanical breakdowns, travel restrictions, worldwide pandemic, protests, political conflict, entry or border issues, and severe weather.

6.1 Inability to provide an event

If, due to reasons beyond our control, an event is unable to take place due to (but without limitation); closure of premises, the ceases of trading, a change in supplier management, weather restrictions, we will provide you and your group with an alternative event and date, and if this is does not prove possible, a refund will be provided to you of the cost to us of the event.

7. MISCELLANEOUS

Any information or advice provided by JWJ Travels regarding visas, vaccinations, weather climate, clothing, baggage, special equipment and anything in relation to the Getaway/Product is simply advisory & simply provided as a courtesy to the client. JWJ Travels will not be held responsible for any mistakes or omissions in the information supplied, or in the information given to clients by third parties such as government or travel authorities.

8. LEGALITY

This agreement shall bind not only yourself but also the members of your family and your spouse, as well as your heirs, and personal representatives if you are deceased. This Agreement shall be considered as a waiver, pledge, acquittal and release to not sue JWJ Travels & its representatives.

9. PARTICIPANT ELIGIBILITY/ HEALTH & FITNESS ASSESSMENT

By participating in the Company’s Getaway and Retreats, “I, the Client, am aware that my involvement is entirely voluntary and may include physically demanding activities such as diving, hiking, running, dancing, swimming, climbing, Getaway workshops, and other forms of physical activities. I understand and accept the potential risks associated with these activities, which may include injuries such as sprains, fractures, muscle strains, heart and breathing-related conditions, or other medical issues, as well as the risk of serious harm or death. Despite these risks, I consciously choose to take part in the activities offered during the Getaway.”

If you decide not to participate in any specific activity, you are under no obligation to do so, as all activities are optional.  Please note that JWJ Travels is not obligated to provide alternative activities. It is solely your responsibility to obtain personal travel insurance that adequately covers all activities and events included in the Getaway.

9.1 HEALTH AND FITNESS DECLARATION

“I confirm that I am at least eighteen (18) years old, in good physical form and mental health, and possess the necessary fitness level to actively engage in the Getaway/Retreat.

Additionally, I affirm that I do not have any medical conditions, injuries or disabilities that would hinder, prevent or restrict my involvement in all aspects of the Getaway. I have consulted my physician and received approval to engage in all physical activities and aspects of the Getaway. Prior to the departure date, I agree to discuss any questions or concerns about my physical or mental health with a qualified healthcare professional and can provide documentation if requested.”

It is essential to note that the Getaway might occur in remote locations with inadequate or no access to traditional and advanced medical services or hospital facilities for severe health issues or those specific to your health. You are responsible for any medical or departure expenses incurred. Therefore, it is a necessary requirement that you obtain travel insurance with sufficient coverage for your specific travel needs, as detailed in Section 5.

JWJ Travels retain the right, at our sole discretion, to decline your participation in any physical activities, workshops, classes or other events based on medical, health, or other relevant concerns. Furthermore, JWJ may refuse participation to anyone exhibiting behavior which poses a risk to themselves or others at any point during the Getaway.

10. RISK ACKNOWLEDGMENT

Before participating in Physical Activities, you should be aware of the potential risks involved, which could result in serious or even fatal injuries. You acknowledge that engaging in certain activities or travelling to certain locations may carry inherent risks that should be considered before booking the Product. The Getaway may occur in remote destinations with limited access to hospitals or medical services. Additionally, you may visit areas with greater risks and challenges than those in your home country. You are responsible for researching and being acquainted with all appropriate travel information related to you partaking in the Getaway.

By engaging in the Getaway, you agree to ACCEPT full responsibility for the inherent risks associated with participating in physical or strenuous activity and travel.

These expected or unexpected risks may involve hazard, injury, death, property loss or damage, and various forms of liability that may arise during your involvement in the Getaway.

You acknowledge that your decision to partake in the Getaway is based on a thorough consideration of this information, and you solely and exclusively accept the risks associated with participating in the Getaway. Under no circumstances will JWJ Travels be held liable for any liabilities occurred from or in relation to you partaking in the Getaway/Retreat.

11. WEBSITE INFORMATION AND CONTRACTUAL TERMS

Prices for Getaways & Services offered by JWJ Travels—including group trips, private trips, package deals, itineraries, travel planning services, and merchandise—are based on prevailing costs at the time they are published on the JWJ Travels website.

JWJ Travels reserves the right to adjust prices at any time prior to receiving full payment of Getaway & Services. Each itinerary, prices, dates and schedules listed are for informational purposes, and the price confirmed at the time of booking will apply, subject to any applicable surcharges outlined in earlier sections. Before a booking is finalized, JWJ Travels may revise, update, or further amend the information provided on our website. Any such changes will take effect as of the amendment date and will be considered part of the agreement.

12. PHOTOGRAPHY RELEASE

Image and Likeness Authorization

By participating in any Getaway or trip with JWJ Travels, you acknowledge that photographs, videos, or other media may be captured by other participants, representatives of JWJ Travels, or affiliated entities, which may feature your image or likeness in whole or part.

In exchange for your participation, you grant JWJ Travels, its agents, representatives, affiliates, successors, assignees, licensees, and employees a permanent, royalty-free, worldwide, and irreversible license to use, advertise, replicate, modify, exhibit, publish, dispense, or otherwise utilize your image, likeness, and voice (“Likeness”) in any medium, whether now known or developed in the future, without compensation or additional obligations to you.

This authorization includes, but is not limited to, the use of your Likeness for marketing, promotions, client testimonials, and commercial purposes. Your Likeness may appear on JWJ Travel website and social media channels, publications, promotional materials, marketing campaigns, and other platforms without restriction.

You further waive any right to review, approve, or receive royalties or compensation for materials featuring your Likeness. This release applies to all media captured during the getaway, whether by JWJ Travels or third parties, and is unrestricted in duration or scope.

13. CREDIT CARD CHARGES

JWJ Travels is not liable for any fees, charges, or taxes imposed by third parties or financial institutions related to credit card or payment transactions associated with your booking. JWJ Travels will not refund or reimburse such charges.

14. CUSTOMER FEEDBACK

If you experience an issue during your Getaway, you must promptly report it to the relevant party, such as the accommodation, restaurant manager, or a JWJ Travels representative. If your issue cannot be resolved, you must notify JWJ Travels in writing within seven (7) days after the event ends. Complaints submitted beyond this timeframe will not be accepted, and it will be assumed you are fully satisfied with the event and services provided. JWJ Travels will acknowledge complaints within five (5) working days and strive to resolve them promptly.

15. CONFLICT RESOLUTION & VENUE

In the event of a conflict between these terms and any other applicable terms, the terms outlined by JWJ Travels shall take precedence. Any disputes arising from this agreement shall be resolved in London, United Kingdom.

LIABILITY WAIVER & RELEASE

RESPONSIBILITY : For booking a travel package and participating in the Getaway, “I, the Client, willingly accept full responsibility for my participation in the Getaway and release, waive, pardon, and hereby agree to not sue JWJ Travels, including its owners, associates, employees, hosts, agents, contractors, guides, and other JWJ representatives, from any and all liabilities such as disputes and claims, actions, accusations, damages or losses. This comprises of, but is not restricted to damaged property, medical fees, sicknesses, incidents & accidents, loss of income, damages, death, whether arising from negligence, contract, liability, tort (& similar) to the maximum extent permitted by law. This release applies regardless of whether such liabilities were anticipated or unforeseen, and whether or not JWJ Travels was advised of the possibility of such occurrences.”

CLIENTS ASSUMPTION OF INJURY

“I, The Client, understand and agree that will I am solely responsible for any medical expenses resulting from injuries sustained during my participation in the Getaway. I acknowledge and expressly agree that the Company and its representatives will not be held liable for any losses, damages or liabilities arising from my involvement in the Getaway.

I agree to fully compensate and protect the company parties from any and all liabilities, including legal fees and expenses, that I may incur as a result of my participation in the Getaway, regardless of whether the company parties were negligent or not (except in cases of gross negligence or willful misconduct by a company party), to the fullest extent permitted by the relevant law.”

As a client, I also acknowledge and accept all risks associated with participating in physical activities during the Getaway.

I, the Client, have been informed and strongly encouraged to obtain appropriate travel insurance at the time of booking and reserving my spot for the Getaway. This insurance provides coverage for potential risks, including loss, trip cancellations or interruptions, weather-related disruptions, natural disasters, illness, work-related issues, protests/strikes, accidents, medical emergencies, pre-existing health conditions, baggage delays, theft, and other liabilities associated with travel and my voluntary participation in the Getaway. I understand and agree that, regardless of whether I choose to purchase travel insurance, I will not seek reimbursement from JWJ Travels or its affiliates for any losses, damages, or liabilities incurred during my travel or Getaway participation.

I further understand that depending on the nature of the Products and Services booked or the destinations involved, there may be significant personal risks associated with participation in the Getaway. Adventure travel, in particular, comes with inherent dangers, and by confirming my booking, I affirm that I have carefully evaluated these risks to my health and safety and have chosen to proceed, accepting these risks. I have assessed the potential hazards, challenges, and risks in consideration of my own capabilities and needs, and I willingly assume full responsibility for traveling under these conditions.

Additionally, I acknowledge that JWJ Travels is not responsible for providing me with information or guidance regarding local customs, weather conditions, safety concerns, physical challenges, or laws in effect at any destination where the Products and Getaway Services are operated. JWJ Travels has strongly recommended that I research and establish contact with my local embassy or consulate in each destination prior to departing for any Getaway organized by JWJ Travels.

I release JWJ Travels, its owners, employees, agents, and affiliated parties from any and all damages or liabilities that may arise from or relate to the negligent or intentional actions of others, including but not limited to co-travelers, other participants, or third parties. This release also applies to events beyond anyone’s control, such as acts of God, force majeure, weather emergencies, equipment or mechanical breakdowns, government actions, illness, attacks by animals, insufficient medical care, criminal acts, terrorism, war, civil unrest, fires, poor sanitary conditions, food quality or safety, quarantines, customs regulations, epidemics, strikes, overbooked accommodations, or inadequate safety and security standards at lodging or other venues.

Additionally, I release JWJ Travels from any liability related to injuries, incidents, or problems resulting from the consumption of alcohol, possession or use of illegal substances, or any other unforeseen circumstances. I agree not to bring any legal claims against JWJ Travels, its members, employees, agents, or contractors for any loss, cost, liability, or damage I may experience due to the actions or omissions of third parties. By agreeing to these terms, I acknowledge and accept the terms of this release and waiver of liability.”

ACKNOWLEDGEMENT

I ACKNOWLEDGE THAT BY BOOKING WITH JWJ TRAVELS, IT INDICATES THAT I HAVE FULLY READ AND UNDERSTOOD THIS LIABILITY AND I ACKNOWLEDGE THAT IT AFFECTS AND LIMITS MY LEGAL RIGHTS AND THAT I HAVE HAD THE OPPORTUNITY TO SEEK INDEPENDENT LEGAL ADVICE TO REVIEW THESE TERMS AND LIMITATIONS ON MY RIGHTS BEFORE ACCEPTING ITS TERMS SHOULD I DISAGREE.
